अब US में भारतीयों की होगी No Entry? H1B वीजा पर आए नए बिल ने बढ़ाई चिंता

अमेरिका में एक ऐसा बिल पेश हुआ है जो लाखों विदेशी प्रोफेशनल्स खासतौर पर भारतीयों के सपनों पर सीधा वार कर सकता है। डोनाल्ड ट्रंप के दौर में इमीग्रेशन को लेकर सख्ती के बीच अब एच वन बी वीजा सिस्टम को पूरी तरह बदलने की तैयारी हो चुकी है। रिपब्लिकन नेता एलिक क्रेन ने एंड एच1 वीजा अब्यूज एक्ट 2026 पेश कर ऐसा प्रस्ताव रखा है जिससे अगर मंजूरी मिलती है तो अमेरिका में नौकरी करने का रास्ता पहले से कहीं ज्यादा मुश्किल हो जाएगा। जो एच वन वीजा सिस्टम को जड़ से बदल सकते हैं। सबसे बड़ा झटका हर साल जारी होने वाले वीजा की संख्या 65,000 से घटाकर सिर्फ 25,000 करने का प्रस्ताव है। इतना ही नहीं अब तक चल रही लॉटरी सिस्टम को भी खत्म कर हाई सैलरी के आधार पर चयन की बात कही गई है। कंपनियों के लिए भी नियम बेहद सख्त होंगे। उन्हें साबित करना होगा कि उन्हें कोई अमेरिकी कर्मचारी नहीं मिला और उन्होंने हाल ही में किसी को नौकरी से नहीं निकाला। एच1वी कर्मचारियों के एक से ज्यादा नौकरी करने की अनुमति नहीं होगी और थर्ड पार्टी एजेंसियों के जरिए हायरिंग पर भी रोक लगाने का प्रस्ताव है। सबसे चौंकाने वाला प्रस्ताव एच1 बी वीजा धारकों को अपने परिवार को अमेरिका लाने की अनुमति नहीं दी जाएगी।

साथ ही इस वीजा को ग्रीन कार्ड में बदलने का रास्ता भी बंद करने की बात कही गई है। यानी यह वीजा पूरी तरह अस्थाई बन जाएगा। इमीग्रेशन एक्सपर्ट रोजमरी जेनेक्स का कहना है कि अगर एच वन वीजा कर्मचारियों को 3 साल बाद वापस भेजा जाएगा तो कंपनियों की लागत बढ़ेगी और वह मजबूर होकर अमेरिकी नागरिकों को ही नौकरी देंगे। इस विल को ब्रैंडन ग्रिल समेत कई रिपब्लिकन नेताओं का समर्थन मिला है। जिन्होंने साफ कहा है कि अमेरिकी नौकरियों पर पहला हक अमेरिकियों का होना चाहिए ना कि विदेशी कर्मचारियों का। अगर यह विल पास होता है तो यह सिर्फ एक पॉलिसी बदलाव नहीं बल्कि अमेरिका में काम करने वाले सपने देखने वाले लाखों युवाओं के लिए बड़ा झटका साबित हो सकता है। 
H-1B वीज़ा प्रोग्राम का इस्तेमाल अमेरिकी टेक्नोलॉजी कंपनियाँ विदेशी प्रोफेशनल्स को नौकरी पर रखने के लिए बड़े पैमाने पर करती हैं; इसमें भारतीय कर्मचारी—खास तौर पर टेक्नोलॉजी और मेडिकल के क्षेत्र में सबसे बड़े लाभार्थी समूहों में से एक हैं। प्रस्तावित सुधारों में मौजूदा लॉटरी सिस्टम की जगह वेतन-आधारित चयन प्रक्रिया लाना शामिल है। इसके तहत, एम्प्लॉयर्स को यह प्रमाणित करना होगा कि कोई भी योग्य अमेरिकी कर्मचारी उपलब्ध नहीं है और हाल ही में कोई छँटनी नहीं हुई है। साथ ही, H-1B कर्मचारियों के एक से ज़्यादा नौकरियाँ करने पर प्रतिबंध लगाया जाएगा और थर्ड-पार्टी स्टाफिंग फर्मों द्वारा उन्हें नौकरी पर रखने पर रोक लगाई जाएगी। अतिरिक्त प्रावधानों के तहत, संघीय एजेंसियों को गैर-प्रवासी कर्मचारियों को प्रायोजित करने या नौकरी पर रखने से रोका जाएगा, 'ऑप्शनल प्रैक्टिकल ट्रेनिंग' प्रोग्राम को समाप्त कर दिया जाएगा, और H-1B वीज़ा धारकों को स्थायी निवास (परमानेंट रेजिडेंसी) में बदलने से रोका जाएगा—जिससे इन वीज़ाओं का अस्थायी स्वरूप और भी मज़बूत होगा।

इस बिल में यह भी अनिवार्य किया गया है कि गैर-प्रवासी कर्मचारी किसी दूसरी वीज़ा श्रेणी में जाने से पहले संयुक्त राज्य अमेरिका छोड़ दें। क्रेन ने कहा कि इस उपाय से अमेरिकियों के लिए रोज़गार के अवसर बढ़ेंगे, वीज़ा नियमों को और मज़बूत किया जाएगा, और घरेलू कर्मचारियों को प्राथमिकता दी जाएगी। उन्होंने कहा, "संघीय सरकार को मेहनती नागरिकों के लिए काम करना चाहिए, न कि बड़ी-बड़ी कंपनियों के मुनाफ़े के लिए। अमेरिकी लोगों के प्रति हमारी यह ज़िम्मेदारी है कि हम इस दोषपूर्ण H-1B सिस्टम को उन्हें उन नौकरियों से वंचित करने से रोकें, जिनके लिए वे पूरी तरह योग्य हैं।
