राज्यसभा ने चार घंटे की लंबी बहस के बाद ‘सस्टेनेबल हार्नेसिंग ऑफ न्यूक्लियर एनर्जी फॉर ट्रांसफॉर्मिंग इंडिया (SHANTI) विधेयक’ को ध्वनिमत से पारित कर दिया। विपक्ष द्वारा इसे संसदीय समिति को भेजने और कई संशोधन लाने के प्रयास खारिज कर दिए गए। हम आपको बता दें कि यह विधेयक भारत की परमाणु शासन-व्यवस्था में एक निर्णायक बदलाव का संकेत देता है, क्योंकि पहली बार किसी परमाणु संयंत्र के पूरे जीवन चक्र यानि निर्माण से लेकर संचालन, अपशिष्ट प्रबंधन और डी-कमीशनिंग तक, सुरक्षा निगरानी को विधिक रूप से अनिवार्य बनाया गया है। उल्लेखनीय है कि अब तक की व्यवस्था मुख्यतः कार्यपालिका के विवेक और दुर्घटना के बाद जवाबदेही पर निर्भर थी।

हम आपको बता दें कि SHANTI विधेयक का उद्देश्य 2047 तक भारत के स्वच्छ ऊर्जा लक्ष्यों को हासिल करना है। इसके तहत देश के कड़े नियंत्रण वाले नागरिक परमाणु क्षेत्र में सीमित निजी भागीदारी की अनुमति दी जाएगी। विपक्ष ने सुरक्षा और दायित्व (लायबिलिटी) को लेकर आपत्तियाँ उठाईं, लेकिन सरकार का कहना है कि यह कानून एक सतत और अनिवार्य सुरक्षा व्यवस्था स्थापित करता है, जो केवल एकमुश्त अनुमतियों पर निर्भर नहीं रहेगी। विधेयक में “परमाणु क्षति के लिए एक व्यावहारिक नागरिक दायित्व व्यवस्था” का प्रावधान है और परमाणु ऊर्जा नियामक बोर्ड (AERB) को विधिक दर्जा दिया गया है।

पहले के कानूनों यानि परमाणु ऊर्जा अधिनियम और 2010 के सिविल लायबिलिटी फॉर न्यूक्लियर डैमेज (CLND) अधिनियम में सुरक्षा को मुख्यतः दुर्घटना के बाद की जिम्मेदारी के रूप में देखा गया था। SHANTI विधेयक इस दृष्टिकोण को बदलते हुए “विधिक, जीवन चक्र आधारित नियामक व्यवस्था” लागू करता है। अब किसी भी गतिविधि यानि निर्माण, संचालन, परिवहन, भंडारण, डी-कमीशनिंग या अपशिष्ट प्रबंधन में विकिरण जोखिम होने पर अलग और स्पष्ट सुरक्षा स्वीकृति अनिवार्य होगी।

यह विधेयक नियमन, प्रवर्तन, नागरिक दायित्व और विवाद निपटान को एक ही कानून के तहत समाहित करता है, जिससे कानूनी जटिलताएँ और अनुपालन की अनिश्चितता घटेगी। AERB को निरीक्षण, जांच, बाध्यकारी निर्देश जारी करने और सुरक्षा मानकों के उल्लंघन पर संचालन निलंबित या रद्द करने का स्पष्ट अधिकार मिलेगा। दुर्घटना रोकथाम को मजबूती देते हुए गंभीर जोखिम स्थितियों को, वास्तविक क्षति नहीं होने पर भी, परमाणु घटना माना जाएगा। हालांकि ईंधन संवर्धन, प्रयुक्त ईंधन का पुनःप्रसंस्करण और भारी जल उत्पादन जैसे मुख्य कार्य केंद्र सरकार के नियंत्रण में ही रहेंगे।

हम आपको बता दें कि मौजूदा ढांचे के साथ परमाणु ऊर्जा का दीर्घकाल में ताप विद्युत का विकल्प बनना मुश्किल था। भारत ने दशकों में केवल लगभग 8 गीगावॉट परमाणु क्षमता जोड़ी है, जबकि 2047 तक इसे 100 गीगावॉट और 2070 तक 300 गीगावॉट या उससे अधिक तक ले जाने के लिए बड़े सुधार जरूरी थे। प्रधानमंत्री नरेंद्र मोदी ने इस विधेयक को देश के तकनीकी परिदृश्य के लिए “परिवर्तनकारी क्षण” बताया है वहीं भाजपा सांसद शशांक मणि त्रिपाठी ने भी इसे देश के लिए एक जरूरी विधेयक बताया है।

देखा जाये तो SHANTI विधेयक केवल एक तकनीकी कानून नहीं है; यह भारत की रणनीतिक सोच का एलान है। दुनिया जब जलवायु संकट, ऊर्जा असुरक्षा और भू-राजनीतिक ध्रुवीकरण के दौर से गुजर रही है, तब भारत ने साफ संदेश दिया है कि ऊर्जा आत्मनिर्भरता अब विकल्प नहीं, राष्ट्रीय सुरक्षा का अनिवार्य स्तंभ है। परमाणु ऊर्जा को हाशिये से निकालकर मुख्यधारा में लाने का यह फैसला साहसी भी है और आक्रामक भी।

अब तक भारत परमाणु सुरक्षा के मामले में “हादसे के बाद मुआवजा” मॉडल पर चलता रहा। SHANTI इस जड़ता को तोड़ता है। यह वही सख्ती है जिसकी मांग अंतरराष्ट्रीय निवेशक भी करते रहे हैं यानि स्पष्ट नियम, स्पष्ट जिम्मेदारी और नियामक की वास्तविक ताकत।

साथ ही सामरिक दृष्टि से भी यह विधेयक विभिन्न मोर्चों पर भारत को मजबूत करता है। ऊर्जा सुरक्षा की बात करें तो कोयले और आयातित गैस पर निर्भरता घटेगी, जिससे वैश्विक आपूर्ति झटकों का असर सीमित होगा। साथ ही इससे भारत का तकनीकी प्रभुत्व कायम होगा क्योंकि निजी भागीदारी से पूंजी, नवाचार और गति आएगी, जबकि संवेदनशील प्रक्रियाएँ राज्य के नियंत्रण में रहकर संप्रभुता सुरक्षित रखेंगी। इसके अलावा जब भारत 2047 तक 100 गीगावॉट परमाणु क्षमता का लक्ष्य रखता है, तो वह केवल बिजली नहीं पैदा कर रहा, वह वैश्विक ऊर्जा राजनीति में अपनी हैसियत बढ़ा रहा है।

बहरहाल, विपक्ष की सुरक्षा संबंधी चिंता सैद्धांतिक रूप से उचित है, लेकिन व्यावहारिक जवाब SHANTI देता है। यह कानून बताता है कि सुरक्षा अब बाध्यकारी शर्त है। AERB को ताकत देने जैसा नियमन भारत को बड़े लक्ष्य साधने की हिम्मत देता है। SHANTI विधेयक भारत का परमाणु घोषणापत्र है जो देश को ऊर्जा के मोर्चे पर आत्मनिर्भर बनायेगा।

कांग्रेस नेता गौरव गोगोई ने कहा कि असम के मुख्यमंत्री हिमंत विश्व शर्मा की धमकियों से उन्हें “कोई फर्क नहीं” पड़ता। कांग्रेस की असम इकाई के अध्यक्ष गोगोई ने बृहस्पतिवार को जोरहाट में पत्रकारों से कहा, “मुख्यमंत्री की धमकियों और डराने की कोशिशों से मुझे कोई फर्क नहीं पड़ता। उन्हें ऐसा करते रहने दीजिए। आजकल उनकी बातों से राज्य के लोगों को फर्क नहीं पड़ता।”

उन्होंने कहा कि मुख्यमंत्री की धमकियों की राजनीति ज्यादा दिन नहीं चलने वाली है। गोगोई ने कहा, “शर्मा अगले चार महीने जो चाहे कर सकते हैं, लेकिन सत्ता से बाहर होने के बाद उन्हें जनता के बीच ही रहना होगा।”

मुख्यमंत्री पिछले कुछ महीनों से गौरव गोगोई और उनकी पत्नी एलिजाबेथ कोलबर्न पर पाकिस्तानी खुफिया एजेंसी ‘इंटर-सर्विसेज इंटेलिजेंस’ (आईएसआई) से संबंध होने का आरोप लगाते हुए लगातार हमले कर रहे हैं। कोलबर्न ब्रिटेन की नागरिक हैं।

राज्य सरकार ने इस मामले की जांच के लिए एक विशेष जांच दल (एसआईटी) का गठन किया था। एसआईटी ने 10 सितंबर को मुख्यमंत्री को अपनी रिपोर्ट सौंपी थी। शर्मा ने पिछले सप्ताह कहा था कि यह मामला केंद्रीय जांच एजेंसी को सौंप दिया जाएगा।

शर्मा ने यह भी कहा कि चूंकि एसआईटी जुबिन गर्ग की मौत से जुड़े मामले में आरोपपत्र दाखिल कर चुकी है, “अब हम गौरव गोगोई के मामले पर आगे बढ़ेंगे।” गर्ग हत्याकांड में अपराध अन्वेषण विभाग (सीआईडी) की विशेष जांच टीम द्वारा दाखिल आरोपपत्र का जिक्र करते हुए गोगोई ने कहा कि राज्य के अनुभवी वकीलों की टिप्पणियों से स्पष्ट होता है कि यह आरोपपत्र “अत्यंत कमजोर” है।

उन्होंने आरोप लगाया, “यह आरोपपत्र मुख्यमंत्री के करीबी सहयोगी श्यामकानु महंत को बचाने की रणनीति के तहत सोच-समझकर तैयार किया गया है। इसमें कई प्रमुख आरोपियों के नाम शामिल नहीं किए गए हैं, जिन्हें किया जाना चाहिए था।
