करीब तीस वर्ष पुराने एक बहुचर्चित मामले में एनआईए ने अलगाववादी संगठन हुर्रियत कांफ्रेंस के छह वरिष्ठ नेताओं के विरुद्ध आरोप पत्र दाखिल कर दिया है। यह मामला 17 जुलाई 1996 को श्रीनगर में एक मारे गए आतंकी के जनाजे के दौरान हुई हिंसा, पुलिस पर हमले, सरकारी संपत्ति को नुकसान पहुंचाने और भारत विरोधी गतिविधियों से जुड़ा है। एनआईए का कहना है कि यह कोई अचानक भड़की भीड़ नहीं थी, बल्कि अलगाववादी सोच को हवा देने, केंद्र सरकार के विरुद्ध माहौल बनाने और जम्मू-कश्मीर में अपनी पकड़ दिखाने की पहले से रची गई साजिश थी।

हम आपको बता दें कि जम्मू स्थित विशेष न्यायालय में दाखिल आरोप पत्र में शब्बीर अहमद शाह, सैयद अली शाह गिलानी, अब्दुल गनी लोन, मोहम्मद याकूब वकील, जाविद अहमद मीर और शकील अहमद बख्शी के नाम शामिल हैं। हालांकि सैयद अली शाह गिलानी, अब्दुल गनी लोन और मोहम्मद याकूब वकील का मामले की सुनवाई के दौरान निधन हो चुका है, इसलिए उनके विरुद्ध कानूनी कार्यवाही समाप्त हो गई है। इसके बावजूद जांच अभिकरण ने आरोप पत्र में उनके कथित दायित्व और साजिश में भूमिका से जुड़े साक्ष्यों का भी विस्तार से उल्लेख किया है।

एनआईए के अनुसार यह पूरा घटनाक्रम उस समय शुरू हुआ जब मारे गए आतंकी हिलाल अहमद बेग के जनाजे का जुलूस श्रीनगर के नाज चौराहे से गुजर रहा था। आरोप है कि इस जुलूस में हथियारबंद आतंकी भी आम लोगों के बीच शामिल हो गए और उन्होंने पुलिस दल पर अंधाधुंध गोलीबारी कर दी। इस हमले में कई पुलिस कर्मी घायल हुए। इसके साथ ही भारी पथराव किया गया, जिससे सरकारी वाहनों को व्यापक नुकसान पहुंचा। जांच में यह भी सामने आया कि हिंसा को सुनियोजित ढंग से भड़काया गया था ताकि कानून व्यवस्था पूरी तरह चरमरा जाए।

आरोप पत्र के अनुसार जुलूस का नेतृत्व कर रहे अलगाववादी नेताओं ने भारत विरोधी, पाकिस्तान समर्थक और देश को बांटने वाली सोच को बढ़ावा देने वाले नारे लगाए। इतना ही नहीं, उन्होंने अपने भाषणों में हथियार उठाने और हिंसक संघर्ष का समर्थन किया। एनआईए का कहना है कि इन भाषणों और नारों का उद्देश्य लोगों को उकसाना, सुरक्षा बलों के विरुद्ध माहौल तैयार करना और अलगाववादी विचारधारा को जन समर्थन दिलाना था।

जांच में यह भी सामने आया है कि जनाजे जैसे संवेदनशील अवसर का इस्तेमाल केवल शोक व्यक्त करने के लिए नहीं, बल्कि भीड़ को भड़काने और हिंसा फैलाने के लिए किया गया। एनआईए के अनुसार यह पूरी योजना अलगाववादी नेतृत्व की सोची समझी रणनीति का हिस्सा थी। इसका मकसद केंद्र सरकार के खिलाफ जन भावना भड़काना, सार्वजनिक अशांति फैलाना, कानून लागू करने वाली एजेंसियों पर हमले के लिए लोगों को उकसाना और जम्मू-कश्मीर में हुर्रियत कांफ्रेंस के प्रभाव का प्रदर्शन करना था।

इस मामले में सभी आरोपियों पर आपराधिक साजिश रचने, हत्या के प्रयास, दंगा करने, लोक सेवकों पर हमला करने तथा गैर कानूनी गतिविधियां रोकथाम अधिनियम की संबंधित धारा के तहत आरोप लगाए गए हैं। वैसे मामला मूल रूप से घटना वाले दिन श्रीनगर के शेरगढी थाना में दर्ज किया गया था। मगर इस वर्ष अप्रैल में केंद्रीय गृह मंत्रालय के निर्देश पर इसकी जांच जम्मू-कश्मीर पुलिस से लेकर एनआईए को सौंप दी गई। इसके बाद मामले की नए सिरे से गहन जांच की गई और उपलब्ध साक्ष्यों के आधार पर आरोप पत्र तैयार किया गया। इसी मामले में पिछले सप्ताह जम्मू की अदालत ने शब्बीर अहमद शाह की जमानत याचिका भी खारिज कर दी थी और उसकी न्यायिक हिरासत आगे बढ़ा दी गई।

देखा जाये तो यह घटनाक्रम एक बार फिर इस सच्चाई को सामने लाता है कि आतंकवाद और अलगाववाद केवल हथियारों के बल पर नहीं, बल्कि भीड़ को भड़काने, भावनाओं का दुरुपयोग करने और झूठे प्रचार के सहारे भी फैलाया जाता है। किसी आतंकी के जनाजे को हिंसा, पुलिस पर हमले और भारत विरोधी अभियान का मंच बनाना लोकतांत्रिक व्यवस्था और समाज दोनों के विरुद्ध गंभीर अपराध है। बहरहाल, तीन दशक बाद ही सही मगर ऐसे मामलों में साक्ष्यों के आधार पर कानूनी कार्यवाही आगे बढ़ रही है तो यह स्पष्ट संदेश है कि कानून का हाथ देर से ही सही, लेकिन दोषियों तक अवश्य पहुंचता है। अलगाववादी सोच, हिंसा और राष्ट्र विरोधी गतिविधियों के लिए लोकतांत्रिक भारत में कोई स्थान नहीं है और देश की एकता, अखंडता तथा संवैधानिक व्यवस्था को चुनौती देने वालों को अंततः न्याय के दायरे में आना ही पड़ेगा।
