Yes Milord: फुटपाथ पर चलना बना मौलिक अधिकार, SC ने Right to Walk का जिक्र कर गाड़ी वालों को क्या कहा?

सुबह का वक्त था। हवा में हल्की सी ठंडक थी और आसमान साफ था। पांच साल का बच्चा अपने पापा का हाथ पकड़े, अपनी नन्ही पीठ पर स्कूल का  बस्ता टांगे, लगभग तेज  कदम बढ़ा रहा था। स्कूल का गेट सामने ही था, लेकिन वहाँ तक पहुँचने के लिए कोई फुटपाथ नहीं था। सड़क पर गाड़ियाँ हर तरफ से बेतरतीब दौड़ रही थीं। पैदल चलने वालों के लिए एक इंच जगह भी सुरक्षित नहीं थी। तभी अचानक, एक जोरदार झटका लगा, और पिता के हाथ से बच्चे की नन्ही उंगलियाँ छूट गईं। पलक झपकते ही सब खत्म हो गया। चंद कदमों की दूरी पर खड़ा स्कूल का गेट वहीं का वहीं रह गया, और एक पिता की दुनिया हमेशा के लिए उजड़ गई। हमारे देश की सड़कों में या तो फुटपाथ है ही नहीं और फुटपाथ अगर है भी तो वहां भी जान सुरक्षित नहीं है। फुटपाथ पर जान सुरक्षित है नहीं तो इंसान चलेगा कहां। क्या फुटपाथ नहीं होना चाहिए। क्या पैदल चलने वालों को सड़क पर चलने का अधिकार नहीं है। इसी बात को सुप्रीम कोर्ट ने बहुत गंभीरता से लिया है। फुटपाथ पर चलना अब मौलिक अधिकार हो गया है यानी कि हमारे संविधान का एक हिस्सा बन गया है।

क्या है पूरा मामला

सुप्रीम कोर्ट ने 19 जून को एक ऐतिहासिक फैसला सुनाते हुए यह बात कही है। जस्टिस पी एस नरसिम्हा ने अपने फैसले में कहा कि अगर कोई सड़क बनाई जाती है तो सरकार और लोकल एडमिनिस्ट्रेशन की यह जिम्मेदारी है कि उसके साथ पैदल चलने वालों के लिए सेफ फुटपाथ भी बनाए जाए और उनका रखरखाव किया जाए। ऐसे फुटपाथ जिन पर क्लियरली लिखा हो कि यह पैदल चलने वालों के लिए है जिस पर गाड़ियां ना चलें। फुटपाथ पर चलने का मौलिक अधिकार किसी भी मोटर वाहन के विशेष अधिकार से ऊपर होगा। यह बात कोर्ट ने किस फैसले को लेकर कही वो भी जान लीजिए। लाइव लॉ की रिपोर्ट के मुताबिक यह फैसला एक सड़क हादसे से जुड़े मामले में आया है। 5 साल का एक बच्चा अपने पिता के साथ स्कूल जा रहा था। तभी एक टैंकर ने उसे टक्कर मार दी जिससे उसकी मौत हो गई। बच्चे के पिता ने ₹25 लाख के मुआवजे की मांग की थी। मोटर एक्सीडेंट क्लेम्स ट्रिब्यूनल ने उन्हें ₹8,20,000 का मुआवजा दिया था। जबकि हाई कोर्ट ने इसे घटाकर ₹4,70,000 कर दिया था।

निश्चिंत होकर पैदल चलना इंसान का बेसिक राइट

सुप्रीम कोर्ट ने हाई कोर्ट का फैसला रद्द करते हुए पीड़ित पिता को ₹11,44,628 का मुआवजा देने का आदेश दिया और कहा कि यह राशि 2 महीने के अंदर दी जाए। इसी केस की सुनवाई के दौरान बेंच ने कहा कि सेफ और निश्चिंत होकर पैदल चलना इंसान की सबसे बुनियादी गतिविधियों में से एक है। बेसिक राइट। यह सीधे तौर पर राइट टू लाइफ से जुड़ा हुआ है। कॉन्स्टिट्यूशन के आर्टिकल 19 एक डी में नागरिकों को देश में फ्रीली घूमने फिरने का अधिकार दिया गया है और पैदल चलना उसी अधिकार का एक हिस्सा है। सुप्रीम कोर्ट ने कहा कि समय के साथ बढ़ती डेवलपमेंट के कारण पैदल चलने वालों को नजरअंदाज कर दिया गया है। चौड़ी सड़कों और एक्सप्रेसवे को डेवलपमेंट का सिंबल बना दिया गया जो ठीक है। मगर इस सबके बीच फुटपाथ पर चलने वाले लोगों का क्या?

फुटपाथ पर बार-बार चढ़ना और उतरना मुश्किल

साल 2013 में सेंट्रल रोड रिसर्च इंस्टिट्यूट ने राजधानी की 14 किलोमीटर लंबी सड़कों का सर्वे किया था। इसमें पाया गया कि 27 पर्सेट हिस्से में फुटपाथ ही नहीं थे। सिर्फ 55 पर्सेट सड़कों पर तय मानकों के अनुसार फुटपाथ मिले। इस लंबे हिस्से में यदि कोई फुटपाथ पर चले, तो उसे 28 बार यानी लगभग हर 100 मीटर पर ऊपर या नीचे उतरना पड़ता था। दिल्ली कैंट में अपने बुटीक रोज पैदल जाने वाली नलिनी भार्गव ने बताया कि वह फुटपाथ पर नहीं चलती। घुटनों में दर्द रहता है और फुटपाथ पर बार-बार चढ़ना उतरना पड़ता है। इसलिए सड़क पर चलना मजबूरी बन जाता है। द्वारका, उत्तम नगर, कीर्ति नगर, नजफगढ़ और पटपड़गंज समेत कई इलाकों में फुटपाथों पर सार्वजनिक शौचालय भी बने हुए है।

संविधान में निहित 

केस पांच साल के एक बच्चे की हादसे में हुई मौत से जुड़ा था। बच्चा अपने पिता के साथ . स्कूल जा रहा था, जब एक टैंकर ने उसे टक्कर मार दी। सुप्रीम कोर्ट ने कहा कि पैदल चलने का अधिकार संविधान के अनुच्छेद 19 (1) (d) के तहत स्वतंत्र रूप से घूमने के अधिकार से जुड़ा है।

SC का फैसला प्राथमिकता नहीं 

शीर्ष अदालत की टिप्पणी से स्पष्ट होता है कि सड़क पर पहला अधिकार पैदल चलने वालों का है। हालांकि देश के ज्यादातर शहरों-महानगरों में सड़कों पुलों का निर्माण जिस तरह हुआ है, उससे यही लगता है कि पैदल चलने वाले किसी की प्राथमिकता में नहीं। कुछेक शहरों को छोड़ दीजिए, तो ज्यादातर में फुटपाथ नदारद हैं। जहां हैं भी, वहां अतिक्रमण की चपेट में हैं। ट्रैफिक को देखते हुए सड़कें तो चौड़ी हो रही हैं, पर फुटपाथों पर ध्यान नहीं जा रहा। अदालत ने सरकार से पैदल चलने के अधिकार को मान्यता देने के लिए कानून बनाने और स्थानीय निकायों की जिम्मेदारी भी तय करने को कहा है। जहां सड़क है, वहां फुटपाथ भी बने और उसका रखरखाव हो। अगर कोई विभाग अपनी जिम्मेदारी पूरी नहीं करता, तो उसके खिलाफ कार्रवाई की जाए। सुप्रीम कोर्ट के आदेश का यह बेहद अहम हिस्सा है कि अगर किसी नागरिक के इस अधिकार का उल्लंघन होता है तो वह कानूनी कार्रवाई और मुआवजे की मांग कर सकता है। इससे जिम्मेदार सचेत रहेंगे।
