भारतीय क्रिकेटर अभिषेक शर्मा ने अपने पर्सनेलिटी राइट्स की सुरक्षा को लेकर दिल्ली हाई कोर्ट में याचिका दायर की है। दरअसल उन्होंने अदालत से मांग की है कि सोशल मीडिया प्लेटफॉर्म पर मौजूद उनकी सहमति के बिना तैयार किए गए AI कंटेंट और कथित रूप से मानहानिकारक सामग्री को हटाने का निर्देश दिया जाए। हालांकि शुरुआती सुनवाई के दौरान अदालत ने पाया कि याचिका के साथ लगाए गए दस्तावेज पूरी तरह व्यवस्थित नहीं हैं, इसलिए फिलहाल कोई अंतरिम आदेश जारी नहीं किया गया।
वहीं सुनवाई के दौरान कोर्ट ने यह भी कहा है कि डिजिटल प्लेटफॉर्म पर पर्सनेलिटी राइट्स और मानहानि से जुड़े मामलों में तथ्यों का स्पष्ट रिकॉर्ड होना जरूरी है। इसी वजह से अभिषेक शर्मा को सभी संबंधित स्क्रीनशॉट और लिंक क्रमवार तरीके से दोबारा दाखिल करने के लिए कहा गया है।
जानिए इस मामले में हाई कोर्ट ने क्या कहा?
दरअसल मामले की सुनवाई जस्टिस ज्योति सिंह की अदालत में हुई। अदालत ने पाया कि जिन यूआरएल और सोशल मीडिया लिंक का याचिका में उल्लेख किया गया है, उनके स्क्रीनशॉट और हलफनामे में पूरी समानता नहीं है। कोर्ट ने इस कमी को गंभीर माना और कहा कि रिकॉर्ड स्पष्ट होने के बाद ही किसी प्रकार का आदेश दिया जा सकता है। वहीं सुनवाई के दौरान अदालत ने यह भी कहा कि आज के डिजिटल दौर में पर्सनेलिटी राइट्स और मानहानि के मामलों के बीच बहुत पतली सीमा होती है। ऐसे मामलों में अदालत को हर दस्तावेज और डिजिटल रिकॉर्ड की सावधानी से जांच करनी पड़ती है। कोर्ट ने अभिषेक शर्मा की ओर से पेश वकील को निर्देश दिया कि सभी स्क्रीनशॉट, संबंधित यूआरएल और दस्तावेज सही क्रम में नए हलफनामे के साथ दाखिल किए जाएं। इसके बाद ही मामले की अगली सुनवाई में आगे की कार्रवाई पर विचार किया जाएगा।
AI पोस्ट से जुड़ा है मामला
वहीं याचिका में अभिषेक शर्मा ने दावा किया है कि सोशल मीडिया पर उनके नाम और तस्वीर का इस्तेमाल करते हुए AI की मदद से ऐसा कंटेंट तैयार किया गया, जिससे उनकी छवि प्रभावित हुई। उनके वकील ने अदालत को बताया कि एक पोस्ट में उनकी मैनेजर को उनकी गर्लफ्रेंड बताया गया था, जिसे उन्होंने गलत और भ्रामक बताया है। इसी आधार पर संबंधित कंटेंट हटाने की मांग की गई है। हालांकि सुनवाई के दौरान मेटा प्लेटफॉर्म्स की ओर से पेश वकील ने अदालत को बताया कि याचिका में दिए गए आठ यूआरएल में से दो लिंक उपलब्ध नहीं थे और उन्हें खोला नहीं जा सका। फिलहाल अदालत ने किसी भी सोशल मीडिया प्लेटफॉर्म को कंटेंट हटाने का निर्देश जारी नहीं किया है।
